Terms of Service

By creating an account or using Home Maintain (the "Service"), you agree to be bound by these Terms. If you do not agree, do not use the Service.

Home Maintain is a home maintenance and capital improvements tracking application that helps homeowners manage routine maintenance tasks, record capital improvements, and track property-related information. The Service is offered on a freemium basis, with a free tier and a paid Premium tier.

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using the Service, you represent that you meet these requirements.

Creating an account. You may sign up using your email and password or via a supported third-party OAuth provider (such as Google). You are responsible for keeping your credentials secure and for all activity under your account.

Account accuracy. You agree to provide accurate information and to keep it current.

Account termination. You may delete your account at any time by contacting us at support@homemaintain.com. We may suspend or terminate accounts that violate these Terms.

Free tier. Certain features are available at no charge subject to usage limits (e.g., number of homes and tasks).

Premium tier. Upgraded features are available via a paid subscription billed monthly or annually. Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method.

Cancellation and refunds. You may cancel your subscription at any time through the billing portal. Cancellation takes effect at the end of the current billing period. We do not offer prorated refunds except where required by applicable law.

Price changes. We may change subscription pricing with reasonable advance notice. Continued use after the effective date constitutes acceptance of the new price.

You agree not to:

You retain ownership of the data you enter into the Service, including maintenance records, capital improvement entries, and uploaded receipts or photos ("Your Content"). By uploading content, you grant Home Maintain a limited license to store, process, and display it solely to provide the Service to you.

You are responsible for ensuring Your Content does not violate any third-party rights or applicable law.

The Service, including its design, software, and branding, is owned by Home Maintain and protected by applicable intellectual property laws. These Terms do not grant you any rights to our name, trademarks, or proprietary technology.

The Service integrates with third-party providers including Stripe (payments) and authentication providers (e.g., Google OAuth). Your use of those services is also governed by their respective terms of service and privacy policies. We are not responsible for third-party services.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Home Maintain does not provide legal, tax, financial, or professional home maintenance advice. Capital improvement records and tax-basis information generated by the Service are for your personal reference only; consult a qualified professional for tax or legal guidance.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, HOME MAINTAIN AND ITS OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

You agree to indemnify and hold harmless Home Maintain and its affiliates from any claims, damages, or expenses (including reasonable attorneys' fees) arising from your use of the Service, Your Content, or your violation of these Terms.

PLEASE READ THIS SECTION CAREFULLY AS IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Governing Law. These Terms are governed by the laws of the State of California, without regard to its conflict-of-law principles.

Mandatory Arbitration. You and Home Maintain agree that any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Service, shall be resolved by binding arbitration, rather than in court.

Class Action Waiver. YOU AND HOME MAINTAIN AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Jury Trial Waiver. YOU AND HOME MAINTAIN ACKNOWLEDGE AND AGREE THAT WE ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY IN FAVOR OF BINDING ARBITRATION.

Exceptions to Arbitration. Either party may bring a claim in small claims court if such claims qualify and remain in small claims court. Either party may also seek injunctive or other equitable relief for the alleged unlawful use of intellectual property.

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms with a new "Last updated" date and, where appropriate, by email. Continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
